PUBLIC COMMENT PERIOD

At this time, members of the public may comment on any item not appearing on the agenda.  Under state law, matters presented under this item cannot be discussed or acted upon by the Board at this time.  For items appearing on the agenda, the public is invited to make comments at the time the item comes up for Board consideration.  Any person addressing the Board will be limited to a maximum of three (3) minutes so that all interested parties have an opportunity to speak.  At all times, please use the microphone and state your name and address for the record.

1.                  9:00 a.m. Presentation honoring Comcast for producing a half-hour public information television show called Tulare County Reports, which airs on Channel 14.

2.                  9:00 a.m. Acknowledge prior donations by Deloria Gregg-Martin, Sence Foundation, and the Visalia Harley Owners Group, which collectively raised $30,000 to purchase and train three new K-9 dogs for the Tulare County Sheriff's Office.  Accept new donation from the Friends of Tulare County in the amount of $4,002 to be used in the Sheriff's K-9 Program.  Approve the necessary budget adjustment.  (4/5ths vote)

3.                  PUBLIC HEARING:   Request from Resource Management Agency to adopt the findings and approve the Tentative Subdivision Map Tract 777 as set forth in Planning Commission Resolution No. 8179 and 8180, submitted by Gary Benton who proposes a single family residential subdivision of 16.94 acres into 14 residential lots in the R-A-43 (Rural Residential-43,000 sq. ft. minimum) Zone on property located on the southeast corner of Avenue 280 (Visalia Road) and Cornucopia Road (Road 182) west of Exeter.  Adopt the Negative Declaration and find that said subdivision map will not have a significant effect on the environment.  Direct the Clerk of the Board to return the Notice of Determination to the Resource Management Agency for future filing with the County Clerk.

Agricultural Commissioner/Sealer

4.                  Approve an agreement with the California Department of Food and Agriculture to provide State subvention funding in an amount up to $29,660 to offset costs of nursery stock and seed inspection services, retroactive to July 1, 2006 through June 30, 2007.

Auditor-Controller/Registrar of Voters

5.                  Approve an agreement with SST Benefits Consulting & Insurance Services to renew deferred compensation consulting services for another three years, retroactive to July 1, 2006.

6.                  Request from the Registrar of Voters to approve the Resolution consolidating Municipal and Special Districts with the General Election and any other election which may be held within the jurisdiction of said Districts on Tuesday, November 7, 2006.  Authorize the election official to perform all necessary and required services to the aforementioned districts relating to the conduct of the Consolidated Election.  Each individual District shall reimburse the County in full for the services performed in connection with these elections, upon presentation of a bill from the election official to the District.  The election official will prepare a certified statement of the results of the election and submit it to each governing body within 28 days of the election.

County Administrative Office

42.             Approve the Revocable License for Use of Real Property with the Administrative Office of the Courts for a time period not to exceed June 30, 2011.  The revocable license allows the Tulare County Superior Court usage of 4,172 square feet on the basement level of the Visalia Courthouse located at 221 Mooney Boulevard.

43.             Approve a Resolution of Intent regarding support for a new court facility in Porterville.  The Administrative Office of the Courts intends to make a Fiscal Year 2007-2008 funding request to the Governor and the State Department of Finance to construct a new nine courtroom facility in or around the City of Porterville.

District Attorney

44.             Accept continued grant funding from the California Department of Justice, Office of the Attorney General, for the Spousal Abuser Prosecution Program in the amount of $66,523 with an in-kind match of $16,631 for a total grant amount of $83,154.  Certify that the grant funds received hereunder shall not be used to supplant expenditures controlled by this body and will hold the Department of Justice harmless from any claims that may arise from the use of grant funds.

Health & Human Services Agency

45.             Approve an agreement with the State of California, Environmental Protection Agency, to accept the Local Enforcement Agency Grant in the amount of $25,137.89 to provide funding to support solid waste facilities permit and inspection programs.

46.             Approve an agreement with the Porterville Development Center for the Intern Program to recruit and retain Clinical Dietitians, retroactive to August 1, 2006.

Resource Management Agency

47.             Approve an amendment to Agreement No. 19660 with Hyde Rentals to extend the term of the agreement for one (1) year for the lease of office space located at 3500 W. Mineral King, Suite A, Visalia to house the Health and Human Services Agency, Adult Services Division.

48.             Approve an amendment to Agreement No. 22699 with Key Government Finance, Inc. regarding the language concerning the "Ownership and Title" of equipment property.  Transfer the title of the equipment to the County for the term of the agreement.

49.             Accept the work as complete by Glen Wells Construction for the asphalt concrete overlay construction of Road 152 from Avenue 144 (State Route 190) to Avenue 192.  Authorize the Chairman to sign the Notice of Completion.  Direct the Clerk of the Board to have the Notice of Completion recorded.

Workforce Investment Board

50.             Appoint William DeLain as the Chairperson to the Tulare County Workforce Investment Board, Inc. Board of Directors for a term ending November 14, 2007.

51.             Request from Resource Management Agency to approve a full or partial waiver of the filing fees (in the amount of actual time billing) for Special Use Permit No. PSP 06-068 (AA) requested by Jenny Lomeli for the establishment of a second residence on a 6,950 sq. ft. parcel in the R-1 (Single Family Residential) Zone.

52.             Request from Resource Management Agency to lift the Septic Tank Moratorium imposed by Board Resolution No. 86-0423-E for the community of Seville.  Allow for the use of private sewage disposal systems in accordance with applicable State law and County Ordinance Code.  Require the installation of dry sewer lines, where necessary, to allow for the connection to the Seville Community Sewer System when capacity becomes available.  Require the connection to the Seville Community Sewer System within 270 days of the sewer system capacity becoming available or within the time frame required by any funding agency, whichever is more restrictive.  Require the payment of appropriate sewer connection fees at the time connection occurs.
