2.                  PUBLIC HEARING: Request from Resource Management Agency to consider establishment of the following Agricultural Preserves:

3.                  PUBLIC HEARING: Request from Resource Management Agency to authorize the submittal of a 2006 Community Development Block Grant General Allocation Application and provide citizens the opportunity to comment on the expenditure of CDBG Program Income funds.  As required by State regulations, authorize the submittal of a 2006 Community Development Block Grant General Allocation application for $546,250 in funding to be distributed as follows:  Tooleville Water System Improvement, $90,000; Plainview Water System Improvement, $140,000; Richgrove Well Rehabilitation, $275,350; and General Administration, $40,900.  Authorize the commitment of local leverage for these activities as follows:  Tulare County Redevelopment Agency, $100,000; and Staff In-Kind, $10,500.  Authorize the transfer of $100,000 CDBG Program Income funds out of the Housing Revolving Loan Account and commit those funds as local leverage to the Richgrove Well Rehabilitation activity.  Authorize the County Administrative Officer, or authorized designee, to act on the County's behalf in all other matters pertaining to the application.  Authorize the Chairman, or authorized designee, to act on behalf of the County, to execute in the name of the County of Tulare, the Standard Agreement, with the State of California, subject to County Counsel review and approval, and so long as said agreement does not substantially differ from prior grant agreements previously approved by the Board.

4.                  PUBLIC HEARING: Request from Resource Management Agency to authorize the submittal of a 2006 Community Development Block Grant General Planning and Technical Assistance (PTA) Application, and Economic Development PTA Application, and provide citizens the opportunity to comment on the expenditure of CDBG Program Income funds.  As required by State regulations, authorize the submittal of the 2006 Community Development Block Grant PTA Grant applications for $140,000 in funding to be distributed as follows:  General PTA Non-Specific - Traver Park Revitalization Study, $35,000; General PTA Project Specific - Tooleville Water System Improvement Project, $35,000; Economic PTA Non-Specific - Business Assistance Revolving Loan Fund, $35,000; and Economic PTA Project Specific - CDBG ED Pre-application for Ly-Con Project, $35,000. Authorize the commitment of local cash match for these activities as follows:  Traver Park Revitalization Study - Tulare County Redevelopment Agency, $700; Tooleville Water System Improvement Project - CD Program Income, $700; Business Assistance revolving Loan Fund - CDBG Program Income, $700; and CDBG ED Pre-application for Ly-Con Project - CDB Program Income, $700.  Authorize the transfer of $2,100 in CDBG Program Income funds out of the Housing Revolving Loan Account and commit those funds as cash match for the PTA activities.  Authorize the County Administrative Officer, or authorized designee, to act on the County's behalf in all other matters pertaining to the application.  Authorize the Chairman, or authorized designee, to act on behalf of the County, to execute in the name of the County of Tulare, the Standard Agreement, with the State of California, subject to County Counsel review and approval, and so long as said agreement does not substantially differ from prior grant agreements previously approved by the Board.

ADJOURN AS THE TULARE COUNTY BOARD OF SUPERVISORS AND

CONVENE AS THE TULARE COUNTY REDEVELOPMENT AGENCY

5.                  Authorize the commitment and expenditure of Tulare County Redevelopment Agency funds in the amount of $100,700 from the following sources:  Richgrove ($100,000) to be used as local leverage for the 2006 Community Development Block Grant General Allocation grant application; and Traver ($700) to be used as match for the General Planning and Technical Assistance application.  Find that leveraging financial resources for studying infrastructure improvements in these communities:  a) is consistent with the adopted Redevelopment Plans for Richgrove and Traver; b) implements the affected Redevelopment Plans by assisting in the eradication of blight caused by inadequate infrastructure and depressed economic development; c) is consistent with the current Implementation Plans adopted pursuant to Health and Safety Code Section 33490; and d) will directly benefit low-or moderate-income persons.  Find that there is no other reasonable and available means of financing the local match for the proposed activities, and that the County does not have available funding for this purpose.  Request the Auditor's Office to make such payments from appropriate accounts.

6.                  PUBLIC HEARING: Request from Resource Management Agency to deny the appeal filed by Raul and JoAnn Gamez and uphold the Zoning Administrator's decision to approve Special Use Permit No. PSP 05-096(ZA) to establish a church facility on 6.69 acres in the AE-20 (Exclusive Agricultural-20 acre minimum) Zone located on the east side of Lovers Lane (Road 140), approximately 550 feet south of Caldwell Avenue, south of Visalia, subject to the conditions as set forth in ZA Decision No. 2785.

District Attorney

8.                  Authorize acceptance of continued grant funding in the amount of $302,871 from the California Department of Insurance for the Worker's Compensation Insurance Fraud Prosecution Program.  Approve the Grant Award Agreement and ratify Phil Cline's signature on behalf of the Chairman, retroactive to July 1, 2006 through June 30, 2007.  Certify that the grant funds received hereunder shall not be sued to supplant expenditures controlled by this body.  Approve the necessary budget adjustments.  (4/5ths vote)

Health & Human Services Agency

9.                  Approve the transfer of Homeland Security Grant Funds from Health and Human Services Agency/Emergency Services to the Sheriff's Department in the amount of $67,734 and the Fire Department in the amount of $59,178.  Approve the Sole Source fixed asset purchase of an x-ray machine for bomb enhancement for the Tulare County Sheriff's Department in the amount of $20,260 from the transfer funding.  Approve the necessary budget adjustments. (4/5ths vote)

10.             Approve an agreement with Family Services of Tulare County, Inc. to provide home based Parent Education and Family Reunification services for clients of Child Welfare Services through June 30, 2007

11.             Approve an agreement with Golden State Air Charter, LLC to provide transportation via fixed wing aircraft, which will allow critical patients requiring medical services in locations outside of Tulare County to be air transported more readily despite of visibility and other environmental factors.

12.             Approve an amendment to Agreement No. 20414 with Tulare District Hospital to increase the rates regarding compensation for providing certain medical care for the indigent population, retroactive to April 1, 2006.

13.             Approve an amendment to Agreement No. 19914 with Kaweah Delta Health Care District to increase the rates regarding compensation for providing certain medical care for the indigent population, retroactive to November 5, 2005.

14.             Approve an amendment to Agreement No. 22453 with First 5 Tulare County for the Medically Vulnerable Infant Program, retroactive to July 1, 2006 through June 30, 2007.

15.             Approve an amendment to Agreement No. 22544 with the State Department of Mental Health for County performance conditions as mandated by Welfare & Institutions code 5650, retroactive to July 1, 2006 through June 30, 2007.

16.             Approve an amendment to Agreement No. 22445 with the Department of Health Services, Immunization Branch for the Health and Human Services Agency to develop and implement local and/or regional automated immunization information and reminder systems in Tulare County, retroactive to July 1, 2006 through June 30, 2007.

17.             Approve an agreement with the California Office of Child Abuse and Prevention for the Father Involvement Study Grant to increase the grant funding by $1,430,000 and to continue through June 30, 2009.  Approve the necessary budget adjustments for Fiscal Year 2006/2007. (4/5ths vote)

18.             Authorization to accept funding in the amount of $725,752 from the State Department of Mental Health for improvements to the current Mental Health computer system by implementing an electronic health records system, an enhanced client scheduling system, and to improve data collection as required by the Mental Health Services Act for Full Service Partnership consumers.  Authorization to purchase fixed assets in the amount of $150,000.  Approve the necessary budget adjustments.  (4/5ths vote)

Probation

19.             Authorization to apply for grant funding from the California Department of Corrections & rehabilitation, corrections Standards Authority for the Mentally Ill Offender Crime Reduction Grant Program.

 

 

Resource Management Agency

20.             Approve and award the contract for asphalt concrete overlay construction of Road 80 from Avenue 326 to Avenue 334 and from Avenue 358 to Avenue 376 to the lowest responsive and responsible bidder, Glen Wells Construction Company, Inc. in the amount of $1,689,340.40.  Authorize the Chairman to sign the contract upon receipt of certificates of insurance, bonds, and contracts after review and approval as to form by County Counsel, and evidence that the contractor possesses a valid State Contractor's License.

21.             Approve the Final Map of Subdivision Tract No. 756 for 31 residential lots on 37.3 acres located on the south side of Pleasant Oak Drive, approximately one mile east of its intersection with State Highway 190, five miles south of Springville.  Approve an agreement with Lynn and Sally Shafer to complete all required public improvements for Subdivision Tract No. 756.  Accept the Road Right of Way dedications of Subdivision Tract No. 756 , subject to road construction completion and acceptance of public improvements.  Accept the Grant Deed for one-foot reserve strip.  Accept the Easement Deeds for road purposes.

22.             Accept the Irrevocable Offer to dedicate real property that was offered for dedication across the remainder parcel of Elbow Estates No. 1 - Tract No. 690, filed September 29, 1994 and recorded in Volume 36, Page 76 of Maps in the office of the Tulare County Recorder.  Accept Irrevocable Offer to dedicate real property that was offered for dedication South of Parcel 8 of Elbow Estates No. 2 - Tract No. 755, filed on November 25, 2003 and recorded in Volume 40, Page 33 of Maps in the office of the Tulare County Recorder.  Direct the Clerk of the Board to cause a Certified Copy of the Resolution accepting the Irrevocable Offer of Dedication to be recorded in the office of the Tulare County Recorder.  Direct the Clerk of the Board to request a confirmed copy of the Resolution accepting the Irrevocable Offer of Dedication be returned to the Resource Management Agency Property Management Division.

23.             Authorize the filing of Notices of Partial Non-renewal for 18 Land Conservation contracts as provided in the Williamson Act with a total affect of 55.96 acres as follows:
