2.                  PUBLIC HEARING: Request from Resource Management Agency to adopt findings to deny the appeal by Raul and JoAnn Gamez and uphold the Zoning Administrator's decision to approve Special Use Permit No. PSP 05-096(ZA), subject to the conditions set forth in ZA Decision No. 2785 or as modified by subsequent Decision.

3.                  PUBLIC HEARING: Request from Resource Management Agency to deny the appeal filed by Michael J.F. Smith, Attorney at Law, on behalf of Don and Sharon Guy regarding Miramonte Sanitation Violation No. V101-084 and uphold the decision of the Administrative Hearing Officer rendered on October 2, 2006 directing Miramonte Sanitation to cease all waste hauling operations and remove trucks, materials, and equipment from their property located at 42605 Road 72 northwest of Dinuba within 10 days and declare this violation (V101-084) as a Public Nuisance .

Background information has been provided to the board on all matters listed under the Consent Agenda, and these items are considered to be routine by the Board.  All items under the Consent Agenda are normally approved by one motion.  If discussion is requested by any Board members on any item, that item will be removed from the Consent Agenda if separate action is required.

 

 

 

Auditor/Controller

4.                  Establish the 2006/2007 Appropriations Limit for the County to be $1,090,801,950 per Government Code Section 7910, documentation used in the determination of the appropriations limit shall be available to the public for review 15 days prior to the meeting.

5.                  Authorize the Tax Collector to amend the effective sale date of Agreement Sale No. 22315, approved by Board of Supervisors Resolution No. 2005-0270 dated May 17, 2005; approved by the State Controller's office on July 14, 2006.  Extend the effective date to April 7, 2007 per the request of Tulare Redevelopment Agency.  Authorize the Tax Collector to charge additional sale fees up to $1,000.00 to the Redevelopment Agency for reimbursement of re-notice and re-publishing costs.

6.                  Ratify Proclamation honoring John "Johnny" George for his generosity and community spirit by donating the land for "The Greatest Generation War Memorial."

7.                  Proclamation honoring November 14, 2006 as Prematurity Birth Awareness Day.

 

County Administrative Office

8.                  Approve and Ratify the County Administrative Officer's delegated actions regarding Contracts and Personnel/Payroll changes for the month of October 2006.

Health & Human Services Agency

9.                  Authorization to submit the Tulare County Wraparound Implementation Plan to the California Department of Social Services to keep at-risk children safely in their homes, community, and schools by creating individualized family plans.  Authorization to begin development of Requests for Proposals as part of the development phase of Wraparound.

10.             Approve an amendment to Agreement No. 20820 with the California Department of Health Services for the AIDS Drug Assistance Program for Fiscal Year 2006/2007 for reimbursement costs associated with the enrollment/certification process to Tulare County, retroactive to July 1, 2006 through June 30, 2007.

11.             Approve an amendment to Agreement No. 21165 with Golden State Health Centers, Inc. d.b.a. Sylmar Health & Rehabilitation Center to extend the term of the agreement to June 30, 2007 for providing stable and long-term maintenance for mentally disabled clients of Tulare County, retroactive to July 1, 2006.

12.             Approve an amendment to Agreement No. 21893 with Envision Resources Inc. to extend the termination date to June 30, 2007 for providing medication savings strategies to the County by facilitating access to Patient Assistance Programs, retroactive to July 1, 2006.

13.             Approve an amendment to Agreement No. 22224 with the California Department of Mental Health for the State Hospital Bed Purchase and Usage, retroactive to July 1, 2005 through June 30, 2006.

14.             Approve an agreement with First 5 Tulare County for the Drug Exposed Infant Planning Project to create a system of care with a seamless referral system for all services related to the drug exposed infant, from substance exposure in utero to exposure in the home environment, retroactive to July 1, 2006 through December 31, 2007.  Approve the Personnel Resolution adding .50 FTE Staff Services Analyst III.  Approve the necessary budget adjustments.  (4/5ths vote)

15.             Accept the award of $39,750 from the Department of Health Services, Tuberculosis Control Branch for Fiscal Year 2005/2007 to support tuberculosis prevention and control activities, retroactive to July 1, 2006 through June 30, 2007.

Resource Management Agency

16.             Approve a two-year extension of time to November 5, 2008 for Tentative Subdivision Map No. TM 742 located on the north side of Avenue 393, 1/4 mile west of Road 34, three miles east of Kingsburg.

 

 

17.             Initiate proceedings to form Assessment District No. 05-773R-STRATHMORE, to pay for the continuing cost of maintenance of the public streets and roadways within Subdivision Tract No. 773 located in the community of Strathmore.  Designate the County Engineer as the Engineer for the purpose of these proceedings.  Direct the Engineer to prepare and file a report with the Clerk of the Board.

18.             Adopt the Countywide Bicycle Transportation Plan in Tulare County to establish various goals and policies regarding bicycle transportation and identify potential future improvements to achieve those goals.

19.             Approve and award a construction contract to Bill Nelson General Construction, as the lowest responsive and responsible bidder, in the amount of $1,111,798.00 for the Richgrove Stormwater Drainage, Air Quality Improvement and Recreation project - Phase 2.  Authorize the Chairman to sign the contract upon receipt of certificates of insurance, bonds, and evidence that the contractor possess a valid State Contractor's License, subject to review and approval as to form by County Counsel.

20.             Approve a Lease Agreement with the Richgrove Community Services District for the lease of equipment owned by the Tulare County Redevelopment Agency to maintain existing streets and roads for a term of three (3) years with an option to renew the lease for an additional three (3) years.

22.             Request from Health and Human Services Agency to approve an assessment increase of an additional $2.00 per $10.00 in fines to fund Emergency Medical Services, pursuant to Senate Bill 1773, beginning January 1, 2007.  This additional $2.00 must be used to fund emergency medical services, however 15% of the funds must be appropriated to pediatric trauma centers or to improve access to, and coordination of, pediatric trauma and emergency services in the County.

 

 

 

23.             Request from the Sheriff-Coroner to accept grant funding in the amount of $81,802 from the U.S. Department of Justice, Office of Community Oriented Policing Services division, for the Secure Our Schools Program.  Authorize the Chairman to sign the Grant Award Facesheet.  Approve agreements with Allensworth Elementary School District; Alpaugh Unified School District; Earlimart Elementary School District; Pixley Union School District; and Tipton Elementary School District.  Approve the Human Resources & Development Resolution amending the Fiscal Year 2006/2007 position allocation listing to add one (1) Deputy II position.  Approve the purchase of one (1) Sheriff's patrol car (fixed asset) to be purchased through the Sheriff's Fleet Vehicle Trust Fund No. 510.  Approve the necessary budget adjustments. (4/5ths vote)
