4.                  PUBLIC HEARING: Request from Resource Management Agency to adopt by reference the findings as set forth in Planning Commission Resolution No. 8225 for Tract 793, Badger Creek Development proposed to divide approximately 377 acres into 74 lots in the PD-F-M-217 (Planned Development - Foothill Combining - Special Mobilehome - 217,000 sq. ft. minimum) Zone, on property located between State Highway 245 and Hogback Road (County Road D-254), north of the intersection of State Highway 245 and Road M465 in Badger.  Find there is no substantial evidence that said Tentative Subdivision will have a significant effect on the environment and certify the Negative Declaration, which has been completed in compliance with the California Environmental Quality Act of 1970, as amended.  Approve the Tentative Map for Tract 793 with exceptions pertaining to lot sizes and lot width and depth, subject to the conditions recommended by the Planning Commission in Resolution No. 8225 and the additional conditions of approval recommended for fire protection.  Direct the Clerk of the Board of Supervisors to return the Notice of Determination to the Resource Management Agency for future filing with the County Clerk.

5.                  PUBLIC HEARING: Request from Resource Management Agency to authorize the submittal of a 2007 Community Development Block Grant (CDBG) Freeze Allocation Application and provide citizens the opportunity to comment on the expenditure of CDBG Program Income funds.  As required by State regulations, authorize submittal of a 2007 CDBG Freeze Allocation application for $300,000 in funding to be distributed as follows: Public Services, $277,500; and General Administration, $22,500.  Authorize commitment of local leverage for these activities as follows:  Tulare County Redevelopment Agency $20,000.  Authorize the program reallocation of $200,000 in CDBG Program Income funds out of the Housing Revolving Loan Account and commit those funds to be expended as local match to the Public Services activity.  Authorize the Chairman of the Board of Supervisors, or authorized designee, to sign the completed application and accompanying documents on behalf of the County.  Authorize the County Administrative Officer, or authorized designee, to act on the County's behalf in all other matters pertaining to the application.  Authorize the Chairman of the Board, or authorized designee, to act on behalf of the County, to execute in the name of the County of Tulare, the Standard Agreement, with the State of California, subject to County Counsel review and approval, and any and all other documents or instruments necessary or required.

6.                  Request from Resource Management Agency to authorize the commitment and expenditure of Tulare County Redevelopment Agency funds in the amount of $20,000 from the following sources:  Cutler-Orosi ($10,000); Ivanhoe ($5,000); and Poplar-Cotton Center ($5,000) to be used as local match for the 2007 Community Development Block Grant Freeze Application.  Find that leveraging financial resources for job training and job assistance in these communities: (a) is consistent with the adopted Redevelopment Plans for Cutler-Orosi, Ivanhoe, and Poplar-Cotton Center; (b) implements the affected redevelopment plans by assisting in the eradication of economic blight caused by a lack of job opportunities; (c) is consistent with the current Implementation Plans adopted November and December 2004, pursuant to Health and Safety Code §33131 (a) and (c) and §33133; and (d) will directly benefit low- or moderate-income persons.  Find that there is no other reasonable and available means of financing the local match for proposed activities, and that the County does not have available funding for this purpose.

Child Support Services

9.                  Approve a Proclamation to recognize and acknowledge the month of August 2007 as Child Support Awareness Month on behalf of the Tulare County Department of Child Support Services and the California Department of Child Support Services.  Approve employee recognition activities during Child Support Awareness Month for the staff of the Tulare County Department of Child Support Services for their efforts to be the best in obtaining support.

Health & Human Services Agency

10.             Reaffirm Declaration of State of Emergency in the Tulare County Winter Freeze 2007.

11.             Approve an amendment to Agreement No. 21583 with RX Relief Pharmacist Specialists in the amount of $150,000 to extend the agreement through June 30, 2008 for providing qualified licensed Pharmacists and Pharmacy Technicians to temporarily assist in staffing at Hillman Health Center Pharmacy during vacancies, vacations, and illnesses, retroactive to July 1, 2007 through June 30, 2008.  Find that the Board had the authority to enter into the proposed Agreement as of July 1, 2007 and that it was in the County's best interest to enter into the Agreement on that date.

12.             Approve an Agreement with Star View Adolescent Center, Inc. in the amount of $150,000 to provide specialty mental health services for children under the jurisdiction of Tulare County who are residing in Los Angeles County through June 30, 2008.

13.             Ratify and approve an Agreement with the California State Association of Counties related to the Welfare Client Data Systems Consortium in the amount of $78,883 for the operations and management of the CalWin application, retroactive to July 1, 2007 through June 30, 2008.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2007 and that it was in the County's best interest to enter into the Agreement on that date.

14.             Ratify and approve an Agreement with the Department of Health Services for Tulare County to participate in the Targeted Case Management Program to assist Medi-Cal eligible beneficiaries in gaining access to needed medical, social, educational, and other services, retroactive to July 1, 2007 through June 30, 2012.  Find that the Board had authority to enter into the proposed Agreement as of July 1, 2007 and that it was in the County's best interest to enter into the Agreement on that date.

15.             Ratify and approve an Agreement with the State Department of Mental Health in the amount of $11,401,017 to provide services related to the development, implementation, and performance reporting of the Mental Health Services Act that support County Mental Health programs, retroactive to April 1, 2006 through June 30, 2008.  Find that the Board had the authority to enter into the proposed Agreement as of April 1, 2006 and that it was in the County's best interest to enter into the Agreement on that date.

Human Resources & Development

16.             Approve an amendment to Agreement No. 20810 with The Holman Group to extend the existing Tulare County Employee Assistance Program contract for three months from August 1, 2007 to October 31, 2007.

17.             Approve the Memorandum of Understanding between the Tulare County In-Home Supportive Services Public Authority and the United Domestic Workers of America, American Federation of State, County and Municipal Employees, retroactive to November 2006.

18.             Reclassify the position of Hazard Abatement Officer (#3106 vacant) to Fire Inspector, Salary Grade 188, effective August 5, 2007.  Reclassify position of Budget Technician (#6392) to Budget Analyst, adopt new class designation and job specification for Budget Analyst, Salary Grade 226, Step 5 ($58,945), effective August 5, 2007.  Reclassify position of County Media Officer (#8162) to Media and Tourism Manager, adopt new class designation and job specification for Media and Tourism Manager, Grade 127, Step 5 ($76,464), effective August 5, 2007.  Adjust compensation for Division Manager HHS-Child Welfare Services (vacant) position from Grade 255, Step 5 ($77,136) to Grade 751, Step 5 ($81,378), effective August 5, 2007.  Reclassify position of Emergency Programs Manager (#0804), Grade 278 ($64,084) to Office of Emergency Services Specialist, Grade 278 ($64,084) and adopt new class designation and job specification for Office of Emergency Services Specialist, effective August 5, 2007.  Allocate one full-time position of Office of Emergency Services Manager, Grade 775, Step 5 ($75,470) and adopt class designation and job specification, effective August 5, 2007.

Resource Management Agency

19.             Approve an Agreement with the Tulare Irrigation District and Styrotek, Inc., for the transfer and conveyance of Class I Water.  Authorize the Resource Management Agency and Dennis R. Keller to take necessary actions to comply with the provisions of the Agreement.

20.             Approve an Agreement with the Southern San Joaquin Municipal Utility District and Frasinetto Farms, for the transfer and conveyance of Class I Water.  Authorize the Resource Management Agency and Dennis R. Keller to take necessary actions to comply with the provisions of the Agreement.

21.             Approve the 2007/2008 Transit Agreement with the City of Woodlake to provide service to County residents in the Woodlake Service Area, retroactive to July 1, 2007. Determine that the Board had the authority to enter into the 2007/2008 Transit Agreement with the City of Woodlake, retroactive to July 1, 2007; and that it is in the County's best interest to enter into the Agreement as of that date.
