2.                  PUBLIC HEARING:   Request from Resource Management Agency to waive the second reading and adopt an Ordinance adding Section 18.8 Planned Community Zone to Ordinance No. 352 of the Tulare County Zoning Ordinance pertaining to planned communities.  Direct the Clerk of the Board to publish the summary Ordinance within five (5) days and to post a certified copy of the complete Ordinance within fifteen (15) days.  Approve the Notice of Exemption for the proposed Ordinance and find that the adoption of the proposed Ordinance is exempt from the California Environmental Quality Act.

NOTICE TO THE PUBLIC

Background information has been provided to the board on all matters listed under the Consent Agenda, and these items are considered to be routine by the Board.  All items under the Consent Agenda are normally approved by one motion.  If discussion is requested by any Board members on any item, that item will be removed from the Consent Agenda if separate action is required.

 

Board of Supervisors

3.                  Approve a legislative letter regarding the impending water crisis facing Tulare County.

County Counsel

4.                  Authorize the issuance and sale of 2007 Grant Anticipation Notes in the name of the Exeter Union High School District.  Approve in form the 2007 Grant Anticipation Note.

County Administrative Office

5.                  Accept  the Countywide Preliminary Facilities Condition and New Civic Center Master Plan Final Report.

Fire Department

6.                  Approve an agreement with the City of Farmersville for the donation of a 2000 Ford Expedition to the City of Farmersville that is no longer useful to the Fire Department.

7.                  Approve an agreement with the Camp Nelson Volunteer Fire Company to accept the donation of a 1989 Ford Fire Patrol Truck to provide the Tulare County Fire Department with a very mobile emergency response vehicle for use in the Camp Nelson area.

Health & Human Services Agency

8.                  Reaffirm Declaration of State of Emergency in the Tulare County Winter Freeze 2007.

9.                  Ratify and approve an agreement with CF Merced, LLC d.b.a. Country Villa Merced Behavioral Health Center, a licensed skilled nursing facility in the amount of $550,000, to provide stabilization and long-term maintenance for mentally disabled clients of Tulare County, retroactive to July 1, 2007 through June 30, 2008.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2007 and that it was in the County's best interest to enter into the agreement on that date.

10.             Ratify and approve an amendment to Agreement No. 22895 between Tulare County Health and Human Services Agency, Department of Mental Health and Tulare County Alcoholism Council, Inc. d.b.a. New Hope in the amount of $198,034, for the continued provision of concurrent drug and alcohol treatment and mental health services, retroactive to July 1, 2007 through June 30, 2008.  Find that the Board had authority to enter into the proposed Agreement as of July 1, 2007 and that it was in the County's best interest to enter into the Agreement on that date.

11.             Ratify and approve the Annual Certification Statements for California Children's Services and Child Health and Disability Prevention respectively, retroactive to July 1, 2007.  Find that the Board had authority to approve the annual Certification Statements as of July 1, 2007 and that it was in the County's best interest to approve the statements on that date.

Human Resources & Development

12.             Ratify and approve the Side Letter of Agreement between the County of Tulare and the Professional Association Tulare County Physicians concerning on-call compensation for Obstetric and Pediatricians/Family Practice/Internal Medicine Staff Physicians.  Find that the Board had authority to enter into the proposed agreement as of September 10, 2007 and that it was in the County's best interest to enter into the agreement on that date.

13.             Approve the recommendation of Human Resources & Development and the Health Plan Advisory Group to enter into an agreement with Health and Human Resource Center, Inc. (dba Horizon Health EAP-Behavioral Services) to provide an Employee Assistance Program to Tulare County employees and their dependents for the period of November 1, 2007 through December 31, 2008 with option to renew for two additional one-year periods. Approval to be contingent upon Health and Human Resource Center, Inc. securing a panel of providers acceptable to the County of Tulare.  Approve the change in the Employee Assistance Program plan design from three visits per incident per person to six visits per incident per person.

14.             Request the California State Association of Counties Excess Insurance Authority allow the County to add an additional health plan option, mirroring the Self-Insured Schools of California Blue Shield of California High Deductible Health Plan - Plan B to be integrated with and made a part of our multi-choice plans in the pooled Excess Insurance Authority medical insurance program; and, further that the Excess Insurance Authority actuarially establish a premium structure for such plan.  Authorize staff in concert with Gallagher Insurance Services to negotiate management fees with Wells Fargo Bank to serve as the County's recommended Health Savings Account vendor.  Authorize Human Resources and Development to pay for water, coffee, tea and/or fresh fruit or cookies at open enrollment meetings.

15.             Approve a memorandum of understanding with the California State Association of Counties Excess Insurance Authority for participation in the California State Association of Counties Excess Insurance Authority Pooled Health Insurance Benefit Program.  Ratify the selection of Chimienti and Associates as the designated eligibility and billing administrator for Tulare County effective September 1, 2007.

Resource Management Agency

16.             Approve an amendment to Agreement No. 22877 with the State of California which extends the agreement to February 16, 2009 to allow the purchase of one 26-passenger Compressed Natural Gas transit bus.
