1.                  PUBLIC HEARING:            Request from Resource Management Agency to adopt findings in support of approving the appeal by Seng and Nina Saephan regarding the Planning Commission's decision to deny General Plan Amendment No. GPA 06-004 and Change of Zone No. PZ 06-006 on a 4.71-acre site located on the northwest corner of State Highway 63 (Road 124) and Avenue 322, north of Visalia.

Board of Supervisors

2.                  Reappoint John Bianco to the Law Library for a term ending December 31, 2008.

3.                  Request from Tulare County Economic Development Corporation to approve the 2007/2008 Comprehensive Economic Development Strategy Report.

4.                  Reappoint Bette George to the Delta Vector Control District for a term ending December 31, 2009.

5.                  Reappoint Sherry Tietjens as District 2 Regular Commissioner to the Tulare County Housing Authority for a term ending December 18, 2011.

6.                  Reappoint Michael Sheltzer to the Law Library for a term ending December 31, 2008

7.                  Ratify Proclamations honoring KTIP as the City of Porterville's 2007 Outstanding Business of the Year; Galaxy 9 Theatre as the City of Porterville's 2007 Outstanding Business of the Year; and, the Porterville Chamber of Commerce as the City of Porterville's Business Champion of a Century.

County Administrative Office

8.                  Approve and ratify the County Administrative Officer's delegated actions regarding Contracts and Personnel Changes for the month of November 2007.

9.                  Request from Capital Projects to authorize the purchase of new shelving and furniture for the Visalia Library utilizing existing California Multiple Award Schedule contracts.  Authorize the County Purchasing Agent to execute any and all purchase orders and agreements necessary to complete the purchase and installation.


Health & Human Services Agency

10.             Concept approval to participate in a project that will pursue legislative block grant funding to improve water systems within disadvantaged communities with little or no resources for necessary upgrades and maintenance.

Human Resources & Development

11.             Approve agreements changing the effective date of the scheduled Benefit Amount increase from December 23, 2007 to November 11, 2007 for employees represented by the following employee organizations:  Central California Association of Public Employees (CCAPE); District Attorney's Criminal Investigators Association Tulare County; Professional Association of Tulare County Physicians; Service Employees International Union; Tulare County Corrections Association; Tulare County District Attorney Investigators Association; and the United Automobile-Agricultural-Implement-Aerospace Workers, effective November 11, 2007.  Approve changing both a) the receipt of the Benefit Amount and; b) the deduction for Insurance Premiums from a 26 pay period cycle to a 24 pay period cycle for employees represented by the above cited employee organizations (including PLEMA for County plan only), effective November 11, 2007.  Approve changing the Benefits eligibility waiting period for new-hire represented employees covered by a Tulare County contracted Health Plan.  Approve the Side Letter of Agreement with the District Attorney's Criminal Investigators Association of Tulare County adding Long Term Disability insurance coverage for unit employees, effective October 14, 2007.  Approve adding the Deferred Compensation Match Program to the benefits package for Fire Captains and Fire Lieutenants subject to the appropriate notice.  Find that the Board had authority to enter into the proposed agreements and that it was in the County's best interest to enter into the agreements on those dates.

Probation

12.             Approve an agreement with the Boys & Girls Club of Tulare County, Inc. to provide youth services at the Ivanhoe Youth Center.

Resource Management Agency

13.             Approve the Christmas Tree Recycling Program and authorize the waiver of refuse disposal fees for Christmas trees accepted at the County landfills from December 26, 2007 through January 12, 2008 during normal operating hours.

14.             Approve a Supplemental Agreement with the State of California, Department of Transportation, to provide grant funds of $85,000 for design services for the construction phase of the Ivanhoe Downtown Improvement Project.

15.             Adopt the Negative Declaration for the Avenue 416 and Road 56 Intersection Improvement Project in the County of Tulare.  Authorize the Chairman to sign said Negative Declaration and Notice of Determination.  Direct the Clerk to the Board of Supervisors to return the signed Notice of Determination to the Resource Management Agency for final filing with the County Clerk.

16.             Approve the execution of five (5) Land Conservation Contracts, as provided in the Williamson Act, for Agricultural Preserves enlarged or established during the 2007 application season as follows:

Preserve No. 4453    -  Costa, Joe and Sharon (39.41 acres, west of Tulare; APN 158-090-004)

Preserve No. 4051    -  Ed Brower Dairy (3.60 acres, northwest of Lindsay; portion of APN 197-030-018) Enlarge Ag Preserve No. 4051

Preserve No. 4454    -  Macklin, Kenneth and Kathleen (25 acres, north of Visalia; APN 051-150-084)

17.             Approve an agreement between the Tulare County Redevelopment Agency and Community Services & Employment Training Inc. for construction of Phase One of the Poplar-Cotton Center Stormwater Drainage, Air Quality Improvement and Recreation Project.

Sheriff/Coroner

18.             Ratify and approve an amendment to Agreement No. 17435-L with the Visalia Unified School District to provide instructional services to Tulare County inmates, retroactive to July 1, 2007 through June 30, 2008.  Find that the Board had the authority to enter into the proposed amendment on July 1, 2007 and that it was in the County's best interest to enter into the amendment on that date.

19.             Request from Sheriff-Coroner to acknowledge and accept monetary donations totaling $25,526 from Friends of Tulare County designated for the Sheriff's K-9 Unit, the Sheriff's Search & Rescue Unit and the Tulare County Peace Officer Memorial.

20.             Request from Resource Management Agency to review the Traffic Engineering staff findings regarding the intersection of Road 204 (Spruce) and Avenue 256 four-way STOP sign request based on a study conducted in accordance with the California Manual on Uniform Traffic Control Devices.  Provide direction to implement the following actions:  Continue the intersection as a two-way STOP; or Pursuant to California Vehicle Code 21354, install a four-way STOP at the intersection of Road 204 (Spruce) and Avenue 256, near the City of Exeter.


 

21.             Request from County Administrative Office to introduce and waive the first reading of an Ordinance to amend Section 1-21-1010 and add Section 1-21-1025 to Chapter 21 of Part 1 of the Tulare County Ordinance Code and repeal the current Part VI and adopt a new Part VI of the Tulare County Ordinance Code pertaining to new provisions and reorganization of business license requirements for Junk Dealers, Peddler, Hawkers, Mobile Food Vendors and other Itinerant Vendors, Public Eating Places and Retailers of Aerosol Paint, Large Marker pens, Paint Sticks and Etching Tools.  Direct the Clerk to publish the Ordinance summary and post a full copy of the Ordinance in the Office of the Clerk of the Board.  Approve the attached personnel resolution adding one (1) Code Compliance Officer to the Resource Management Agency and adding one (1) County Financial Technician III to the Tax Collector's position allocation.  Waive the second reading and adopt the Ordinance on December 18, 2007.
