Auditor-Controller/Treasurer-Tax Collector/Registrar of Voters

2.                  Introduce and waive the first reading amending Tulare County Ordinance Code Subdivision (c) of Section 7-01-2560 pertaining to waiver of the requirement to secure the payment of estimated property taxes and special assessments on lot line adjustments prior to the recordation of the decision on the lot line adjustment.

3.                  Approve the Treasurer/Tax Collector's Statement of Investment Policy per Fiscal Year 2008/2009, pursuant to Government Code Section 53646.  Approve the renewal of authority to the Tulare County Treasurer-Tax Collector to invest and re-invest the funds of Tulare County and funds of other depositors in the County Treasury, pursuant to Government Code Section 27000.1.

4.                  Review and accept the Certified Statement of Vote as submitted by the Registrar of Voters for those Offices/Measures for which the Board of Supervisors is the governing body.

5.                  Cancel the following regular meetings for the Board of Supervisors July 15, 2008; August 5, 2008; and August 19, 2008.

6.                  Ratify Proclamation Honoring the Ivanhoe Vision Project Committee for its Community Efforts.

7.                  Appoint Jack Ritchie to the Airport Land Use Commission, Member No. 2-Aviation for a term ending December 31, 2011.

10.              Appoint the following to the Tulare County Youth Commission for terms ending June 24, 2011:

 

11.             Approve an agreement with Alcalde & Fay in the amount of $76,385 for Federal legislative services.  Authorize the Chairman to sign, subject to review and approval as to form by County Counsel.

12.             Approve the Lease Agreement with the Cutler-Orosi Joint Unified School District for the Step Up Youth Center at 41414 Road 128 in Orosi.  Authorize the Chairman to sign the Agreement, subject to review and approval as to form by County Counsel.

Child Support Services

13.             Authorize Peggy Anderson, Director of the Department of Child Support Services, to sign the agreement between the California Department of Child Support Services and the Tulare County Department of Child Support Services.  Find that the Board had authority to enter into the proposed agreement as of June 1, 2008 and that it was in the County's best interest to enter into the agreement on that date.

County Counsel

14.             Ratify and approve the purchase of a high speed scanner, Fujitsu Model FI 5750C in the amount of $6,160 for replacement of an existing scanner that is no longer repairable, retroactive to the purchase date of May 22, 2008.  Find that the Board had authority to purchase the scanner as of May 22, 2008 and that it was in the County's best interest.  Approve the necessary budget adjustments.  (4/5ths vote)

Health & Human Services Agency

15.             Approve an amendment to Agreement No. 23266 with Seneca Center to extend the term of the agreement to June 30, 2009 to provide Intensive Day Treatment Services (Full Day) and Specialty Mental Health Services to Tulare County minors ages 6 to 17 years.

16.             Approve an amendment to Agreement No. 23414 with Staff Care, Inc. to extend the term of the agreement to June 30, 2009, update the services and compensation to provide Locum Tenens Psychiatrists for use in the Tulare County Health and Human Services Agency (HHSA), Mental Health Department and its clinics.

17.             Approve an amendment to Agreement No. 23239 with California Psychiatric Transitions, Inc. (CPT) to extend the term of the agreement to June 30, 2009 to provide mental health rehabilitation services to Tulare County residents who require continuous supervision.

18.             Ratify and approve an amendment to Agreement No. 22444 with Tulare County Workforce Investment Board for the coordination of the Welfare to Work Placement Program, retroactive to July 1, 2007 through June 30, 2010. Find that the Board had authority to enter into the proposed agreement as of July 1, 2007 and that it was in the County's best interest to enter into the agreement on that date.

19.             Ratify and approve an amendment to Agreement No. 22045 with the California Department of Health Services, Offices of Family Planning for the TeenSMART Program to provide prevention services to youth throughout Tulare County aimed at reducing teenage pregnancy, retroactive to January 1, 2004 and extending through June 30, 2011.

20.             Approve an agreement with Cordes Consulting, Inc. in the amount of $171,300 to provide assistance with the Maintenance and Operations of the CalWIN system used for the various welfare benefit programs administered by HHSA from July 1, 2008 through June 30, 2009.

21.             Ratify and approve an agreement with the California Department of Mental Health for providing State Hospital Bed Purchase and Usage, retroactive to July 1, 2007 through June 30, 2008. Find that the Board had authority to enter into the proposed agreement as of July 1, 2007 and that it was in the County's best interest to enter into the agreement on that date.

22.             Ratify and approve the agreement with Jou Rong Lee, M.D. to provide Surgery Services as an Orthopedic Physician, retroactive to June 1, 2008 through June 30, 2009. Find that the Board had authority to enter into the proposed agreement as of June 1, 2008 and that it was in the County's best interest to enter into the agreement on that date.

23.             Approve a "template" agreement for organizations receiving supplies and equipment through the Bioterrorism Preparedness Program for the purpose of planning and preparing for Bioterrorism, Pandemic Influenza and other public health threats. Delegate the Agreement signature authority to the County Administrative Officer for all Agreements between Tulare County Health and Human Services Agency, Bioterrorism Preparedness Program and recipient organizations.

24.             Approve the purchase of a two-year service agreement for the Connect-CTY Telephone Emergency Notification System between Tulare County Health and Human Services Agency (HHSA) and Blackboard, Inc. that rapidly delivers an unlimited number of messages via multiple forms of communication (i.e. telephones, cell phones, pagers, PDAs, and e-mail). Accept the Fiscal Year 2007 Telephone Emergency Notification System (TENS) funds in the amount of $186,297 from the Governor's Office of Homeland Security and approve the necessary budget adjustments per the attached AUD 308 (4/5ths vote required).

Probation

25.             Approve a grant application to Pacific Gas & Electric Company for energy conservation and environmental improvement for the purchase of trees and shrubbery for the Tulare County Youth Facility.

26.             Approve an amendment to Agreement No. 21731 with the Exeter Union School District and Agreement No. 21657 with the City of Lindsay to provide the services of Probation Officers for the continued operation of the Thunderbolt Delinquency Prevention Program effective July 1, 2008 through June 30, 2009.

27.             Approve an agreement with the Tulare County Office of Education, Reconnecting Youth Program in an amount not to exceed $21,000 to provide services to detained youth through June 30, 2009.

 

28.             Approve the agreement and accept the awarded funds from the State of California, Corrections Standards Authority, in the amount of $24,146 for the Juvenile Accountability Block Grants Program for Fiscal Year 2008/2009.  Agree to provide all matching funds in the amount of $52,073 required for said project, and abide by the statutes and regulations governing the JABG Program as well as the terms and conditions of the Grant Agreement as set forth by the Corrections Standards Authority.  Find that the grant funds received hereunder shall not be used to supplant expenditures controlled by this body.

Resource Management Agency

29.             Set a Public Hearing for July 8, 2008, at 9:30 a.m. for placing delinquent Community Service Area No. 1 and Community Service Area No. 2 service fee charges on the 2008/2009 Tax Rolls.  Approve the Notice of Public Hearing.

ADJOURN AS THE TULARE COUNTY BOARD OF SUPERVISORS AND

CONVENE AS THE TERRA BELLA SEWER MAINTENANCE DISTRICT

30.             Set a Public Hearing for July 8, 2008 at 9:30 a.m. for placing delinquent Terra Bella Sewer Maintenance District service fee charges on the 2008/2009 Tax Rolls.  Approve the Notice of Public Hearing.

ADJOURN AS THE TERRA BELLA SEWER MAINTENANCE DISTRICT AND

RECONVENE AS THE TULARE COUNTY BOARD OF SUPERVISORS

31.             Award a construction contract for the Sequoia Field Airport Runway Rehabilitation Project to RJ Berry Jr. Inc., as the lowest responsive and responsible bidder, in the amount of $1,512,150.   Authorize the Chairman of the Board to sign the construction contract upon:  Receipt of certificates of insurance and bonds and evidence that the contractor possesses a valid State Contractor's License; after review and approval as to form by County Counsel; and receipt of letter from Federal Aviation Administration (FAA) authorizing award of construction contract.

32.             Ratify and approve the Generating Facility Interconnection Agreement and Appendix B, the Interconnection Facilities Financing and Ownership Agreement, both with Southern California Edison (SCE) for the Co-Generation installation at the Bob Wiley Detention Facility located at 36712 Rd.112, Visalia, CA, retroactive to March 21, 2006.  Find that the Board had the authority to enter into the proposed agreement as of March 21, 2006 and that it was in the County's best interest to enter into the agreement on that date.

33.             Approve the Plans and Specifications for the construction of Rubberized Asphalt Concrete overlay on Avenue 256 from Road 116 to Road 140 and Asphalt Concrete overlay on Road 168, Diagonal 168 and Road 164 from Avenue 232 to Avenue 256.  Authorize the Chairman of the Board of Supervisors to sign the Plans.  Approve the Advertisement for Bids of the said project.  Set the Bid Opening date for Thursday, July 31, 2008 at 10:00 a.m.  Reaffirm that the project will have no significant impact on the environment pursuant to a Categorically Exemption from the California Environmental Quality Act (CEQA) and a Categorically Exclusion from the National Environmental Policy Act (NEPA) approved on May 20, 2008.

34.             Authorize submittal of a 2008 CalHome Grant application for $900,000 in response to the Notice of Funding Availability issued on April 18, 2008 for implementation of an Emergency Repair Program and a First-Time Homebuyer Mortgage Assistance Program in the Tulare County Redevelopment Project Areas of Cutler-Orosi, Earlimart, Goshen, Ivanhoe, Pixley and Poplar-Cotton Center.  Authorize the waiver of building permit fees of $12,000, which is consistent with the County's adopted Housing Element Objective 2.13.  Adopt CalHome Emergency Repair Program Guidelines.  Adopt CalHome First-Time Homebuyer Mortgage Assistance Guidelines.  Agree that if the application for funding is approved, the County will use the CalHome funds for eligible activities in the manner presented in the application as approved by the Department of Housing and Community Development (HCD) and in accordance with Chapter 84, Statutes of 2000 (SB 1656 Alarcon) and codified in Chapter 6 (commencing with Section 50650) of Part 2 of Division 31 of the Health and Safety Code.  Authorize the Chairman of the Board to execute in the name of the County of Tulare, the application, the Standard Agreement and all other documents required by HCD for participation in the CalHome Program, subject to County Counsel review and approval.

ADJOURN AS THE TULARE COUNTY BOARD OF SUPERVISORS AND

CONVENE AS THE TULARE COUNTY REDEVELOPMENT AGENCY

35.             Authorize the commitment of Tulare County Redevelopment Agency (TCRA) funds in the amount of $70,000 from the following Redevelopment Project Areas:  Cutler-Orosi ($15,000), Earlimart ($10,000), Goshen ($15,000), Ivanhoe ($10,000), Pixley ($10,000), and Poplar-Cotton Center ($10,000), for administration of the 2008 CalHome Grant.  Authorize the commitment of TCRA funds in the amount of $12,000 for building permit fee waivers from the following Redevelopment Project Areas: Cutler-Orosi ($2,000), Earlimart ($2,000), Goshen ($2,000), Ivanhoe ($2,000), Pixley ($2,000) and Poplar-Cotton Center ($2,000).  Find that financing administration of a grant that will alleviate serious health and safety issues in these communities is (a) consistent with the adopted Affordable Housing Component and the Redevelopment Plans for Cutler-Orosi, Earlimart, Goshen, Ivanhoe, Pixley and Poplar-Cotton Center; (b) implements the affected Redevelopment Plans by assisting in the eradication of blight caused by deteriorated and dilapidated housing units and (c) is consistent with the affected Implementation Plans adopted pursuant to Health and Safety Code 33590.  Find that there are no other reasonable available means of financing grant administration and that the County does not have available funding for this purpose.

36.             Approve an amendment to Agreement No. 19875 with the Tule River Indian Tribal Council extending the term of the agreement to August 31, 2008 to provide law enforcement services on the Tule River Indian Reservation.

37.             Authorize an online application to the U.S. Department of Homeland Security for a Commercial Equipment Direct Assistance Program Grant to provide rural law enforcement agencies with state-of-the-art equipment to help accomplish their Homeland Security goals.

38.             Authorize the submittal of an application for Fiscal Year 2008/2009 for grant funding in the amount of $575,100 from the Governor's Office of Emergency Services for the Sexual Assault Felony Enforcement (SAFE) Program.  Authorize the Chairman to sign the Grant Award Face Sheet and Certificate of Assurance of Compliance.  Approve an amendment to Agreement No. 23093 with Family Services of Tulare County to extend the term through June 30, 2009 to provide educational services for the SAFE Program at $3,140 per month.

Workforce Investment Board

39.             Ratify and approve a subgrant agreement with the State of California, Employment Development Department, for the Workforce Investment Act Youth programs to operate youth programs focused on employment training, retroactive to April 1, 2008 through June 30, 2009.  Find that the Board had authority to enter into the proposed agreement as of April 1, 2008 and that it was in the County's best interest to enter into the agreement on that date.

41.             Request from County Counsel to authorize the Risk Manager to maintain the $250,000 self-insured retention.  Authorize continued participation in CSAC-EIA liability pools General Liability I and General Liability II.  Authorize Risk Management to obtain additional coverage limits up to $51 million at a cost not to exceed $1,842,777 in total premium.

42.             Request from County Counsel to authorize renewal of the Workers' Compensation Insurance Program.  Direct Risk Management to maintain a self-insured retention of $1,000,000.  Select a coverage option and direct Risk Management to purchase Workers' Compensation Excess Insurance coverage from the three available options:  a) Renew the Workers' Compensation Program as expiring with a $1,000,000 self-insured retention and excess coverage over the SIR with ARCH; b) Renew the Workers' Compensation Program with a $100,000 self-insured retention under partial insurance policy with Liberty Mutual from $100 thousand to $1 million with excess coverage over the $1 million stop loss with ARCH; and c) Renew the Workers' Compensation Program with a $1 million self-insured retention and excess coverage through CSAC EIA.

43.             Request from County Administrative Office - Capital Projects to award the contract for the Motor Pool Relocation Project to the lowest responsible bidder Atkins Bergreen, Inc. as determined by California Public Contract Code Section 20103.8.b.  Select from the following options, as provided for in California Public Contract Code Section 20103.8:  a) award the base contract in the amount of $1,183,000; b)award the base contract and bid alternate #1 in the amount of $1,317,000; c) award the base contract and bid alternate #2 in the amount of $1,524,000; d) award the base contract and bid alternates #1 & 2 in the amount of $1,658,000; e) do not award the base contract or any bid alternates and direct staff to take other action.  Authorize the Chairman to sign the agreement upon receipt of certificates of insurance, bonds and contract after review and approval as to form by County Counsel and evidence that the Contractor possesses a valid State contractor's license,
