4.                  PUBLIC HEARING:   Request from the Resource Management Agency to certify that it has reviewed and considered the information contained in the Notice of Exemption prepared for the proposed Change of Zone and finds the rezoning is consistent with implementation of the Poplar-Cotton Center Community Plan, approved on December 10, 1996 by Tulare County Board of Supervisors Resolution No. 96-1052, for which an Environmental Impact Report (SCH #96072007) has been previously certified in compliance with the California Environmental Quality Act and the State Guidelines for the Implementation of the California Environmental Quality Act of 1970, prior to taking action.  Find that the project is in compliance with the previous Environmental Impact Report (EIR) and substantial changes are not proposed in the Change of Zone which will require revisions of the previous EIR and that there are no project specific impacts associated with the Zone Change, per Article 12, Section 15183, and determine that the Notice of Exemption reflects the independent judgment of the County and has been completed in compliance with the California Environmental Quality Act and the State Guidelines for Implementation of the California Environmental Quality Act of 1970, as amended. Adopt the findings for approval for the Change of Zone, as set forth in Planning Commission Resolution No. 8571.  Waive the final reading and adopt an amendment to Ordinance No. 352, the Tulare County Zoning Ordinance for Change of Zone No. PZ 10-003 (Pam Fitzpatrick), from AE-20 (Exclusive Agriculture - 20 acre minimum) to R-1 (Single Family Residential) and R-A-20 (Rural Residential - 20,000 sq. ft. minimum), on approximately 77 acres, located on the south side of Avenue 152, approximately 1,700 feet west of Road 192, in Poplar-Cotton Center.  Direct the Clerk of the Board of Supervisors to publish the adopted Ordinance and the Resource Management Agency to file the Notice of Exemption with the County Clerk.

Agricultural Commissioner/Sealer

5.                  Approve the waiver of the requirements for written competitive bids and authorize the Purchasing Agent of Tulare County to purchase pre-mixed vertebrate pest control bait directly from the Kings County Agricultural Commissioner for resale to the citizens of Tulare County.

 

Board of Supervisors

6.                  Appoint Brett Taylor to the Tulare County Youth Commission, for a term ending June 24, 2014.

7.                  Appoint Doug Pingel to the Tulare Housing Authority for a term ending December 18, 2011.

8.                  Appoint Rebecca Donabed, Ronald Allan, Mae Brixey and Darlene Martin to the In Home Supportive Services Advisory Committee, for terms ending June 30, 2014.

County Administrative Office

9.                  Ratify actions by the County Administrative Officer during the month of July 2011 regarding Personnel/Payroll Changes and Good Works Funding Agreements.

District Attorney

10.             Approve an amendment to Agreement No. 24021 with the California Emergency Management Agency to accept an additional grant funding in the amount of $154,263 for the Central Valley Rural Crime Prevention Program.

11.             Approve an amendment to Agreement No. 24022 with the California Emergency Management Agency to accept additional grant funding in the amount of $111,337 for the Vertical Prosecution Block Grant Program.

Information & Communications Technology

12.             Approve an amendment to Agreement No. 14242 with CGI, Inc. to extend the term of the statement of work to September 30, 2011 for ongoing maintenance of the AFIN software, retroactive to July 1, 2011.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2011, and it was in the County's best interest to enter into the agreement on that date.

Resource Management Agency

13.             Approve an amendment to Agreement No. 24323 with Community Services & Employment Training, Inc. to increase the amount of the agreement from $627,588 to $1,627,588 for the implementation of the Neighborhood Stabilization Program Grant and Program Income funds provided by the State of California, Department of Housing and Community Development Grant No. 09-NSP1-6270.

14.             Approve Program Supplement No. N053 to Administering Agency-State Agreement for Federal-Aid Project No.06-5946R for design of pedestrian improvements on Avenue 196 from Balfour Road to Road 230 and on Road 230 from Avenue 196 to Avenue 198.

15.             Adopt an Enforceable Obligation Payment Schedule related to the Tulare County Redevelopment Agency.  Direct the staff to post the Enforceable Obligation Payment Schedule on the County's website.  Direct staff to transmit the Enforceable Obligation Payment Schedule to the County Auditor-Controller, the State Controller and the Department of Finance.

16.             Approve an agreement with U.S. Department of Justice, Drug Enforcement Administration for participation in the Drug Enforcement Administration FAST Task Force, retroactive to  August 1, 2011 through September 30, 2011.  Find that the Board had the authority to enter into the proposed agreement as of August 1, 2011, and that it was in the County's best interest to enter into the agreement on that date.

17.             Approve an amendment to Agreement 23796 with U.S. Department of Justice for the Annual Federal Equitable Sharing Agreement, retroactive to July 1, 2011, through June 30, 2012.  Find that the Board had the authority to enter into the proposed agreement as of July 1, 2011, and that it was in the County's best interest to enter into the agreement on that date.

18.             Request from the Auditor-Controller to approve the Rate of Taxation of the State and County for Fiscal Year 2011/12 to be collected upon the taxable property of the County of Tulare, State of California, at the rate of $1 per $100 of assessed valuation (Article XIII California Constitution).  Approve the tax rates as shown on Schedule A be levied and direct they be collected upon each $100 valuation of the taxable property of the unitary and operating non-unitary property of the County of Tulare, State of California, as computed pursuant to the provision of law (Revenue and Taxation Code Section 100).  Approve the tax rates as shown on Schedule B be levied and direct they be collected upon each $100 valuation of the taxable property of the several school districts of said County, for raising the necessary amount to pay the principal and interest on the bonds and for special purpose of said school districts (Revenue and Taxation Code Section 93).  Approve the Special District Tax Rates as shown on Schedule C be levied and direct they be collected upon each $100 valuation of the taxable property of the various districts included on the schedule of Special Districts (Revenue and Taxation Code Section 93).  Approve and accept the Statement of the Valuation of the Property in Tulare County as compiled by the County Auditor-Controller/Treasurer-Tax Collector (Auditor) and filed with this Board [Government Code 25254(a)].

19.             Request from the Auditor-Controller to approve the Resolution authorizing the issuance of Tax and Revenue Anticipation Notes for 2011/12 Fiscal Year.

20.             Request from the County Administrative Office to approve the creation of a Stakeholder Oversight Committee for the County of Tulare Disadvantaged Community Water Study.  Approve the Bylaws for the Stakeholder Oversight Committee.

21.             Request from the County Administrative Office to consider, modify as needed, and approve the responses to the Tulare County Grand Jury 2010/11 Final Reports regarding:  Pertussis (Whooping Cough) A Deadly Menace; Salary Spiking and Other Benefit Enhancements; and Tulare County Employee Retirement Plan.  Authorize the Chairman to sign the response letters.
