At this time, members of the public may comment on any item not appearing on the agenda.  Under state law, matters presented under this item cannot be discussed or acted upon by the Board at this time.  For items appearing on the agenda, the public is invited to make comments at the time the item comes up for Board consideration.  Any person addressing the Board will be limited to a maximum of three (3) minutes so that all interested parties have an opportunity to speak with a total of fifteen (15) minutes allotted for the Public Comment Period.  At all times, please use the microphone and state your name and address for the record.

5.                  PUBLIC HEARING:   Request from the Resource Management Agency to consider the vacation of Alta Lane north of Brewer Lane in Wilsonia.  Determine that the vacation is exempt from the California Environmental Quality Act pursuant to the adopted Tulare County CEQA Guidelines as a Class 5(e), Abandonments of existing street, alley and utility easements on which no road improvements exist, and the Environmental Assessment Officer is directed to sign and file a Notice of Exemption with the Tulare County Clerk.  Determine that the hereinbefore described portion of Alta Lane is unnecessary for present or prospective public use and vacation thereof is in the public interest.  Approve the Resolution to vacate the aforementioned portion of Alta Lane, subject to the merger of underlying lots including APN 001-041-29 and APN 001-041-30.  Said merger to be completed by January 31, 2012 or the vacation becomes null and void.  Direct the Clerk of the Board to cause a certified copy of the Resolution to be recorded in the office of the Tulare County Assessor Clerk/Recorder concurrent with the recording of the action merging all of the underlying parcels and existing assessor parcels.

6.                  PUBLIC HEARING:   Request from the Resource Management Agency to approve the Tulare County Area Transit fare adjustments in accordance with Government Code Section 54986 as listed in Summary of Proposed Fares.  Adopt the recommended fares and authorize the Resource Management Agency to implement the fares beginning January 1, 2012.

Background information has been provided to the board on all matters listed under the Consent Agenda, and these items are considered to be routine by the Board.  All items under the Consent Agenda are normally approved by one motion.  If discussion is requested by any Board members on any item, that item will be removed from the Consent Agenda if separate action is required.

 

 

 

Auditor-Controller/Registrar of Voters/Treasurer-Tax Collector

7.                  Approve an amendment to Agreement No. 23321 with the Secretary of State to shorten the term of the agreement and terminate on August 18, 2011, and reduce the funding by $206,058.29 to a new maximum of $48,985.09 for Federal Help America Vote Act funds, retroactive to August 18, 2011.  Find that the Board had authority to enter into the proposed agreement as of August 18, 2011, and that it was in the County's best interest to enter into the agreement on that date.

 

8.                  Approve a new agreement with the Secretary of State for Federal Help America Vote Act funds in the amount of $206,058.29, retroactive to September 19, 2011 through December 31, 2015.  Find that the Board had authority to enter into the proposed agreement as of September 19, 2011, and that it was in the County's best interest to enter into the agreement on that date.

9.                  Authorize the Tax Collector Division to maintain four cash drawers by establishing a change fund of $800 or $200 per drawer for the purpose of making change while taking cash payments for taxes.

10.             Appoint J. Steven Worthley, Member and Allen Ishida, Alternate Member to the CSAC Board of Directors for a term ending November 2012.

County Administrative Office

11.             Approve the deletion of Administrative Regulation No. 10 regarding Motor Pool Check-out Vehicles.

Resource Management Agency

12.             Allow the use of the Tulare County name for the submission of a State of California, Department of Public Health, Safe Drinking Water State Revolving Fund grant application for planning funds in the amount of $495,000 for the Monson Safe Drinking Water Planning Project.

13.             Approve the Streambed Alteration Agreement with the California Department of Fish and Game for the Mountain Road M319 Bridge Replacement project.

14.             Approve an extension of the sunset date for the collection of the service fee for the Abandoned Vehicle Abatement Program in Tulare County to April 30, 2022.

Sheriff/Coroner

15.             Approve a direct allocation of $490,230 from the California State Controller's Office to operate the Tulare County Clandestine Laboratory Unit, retroactive to July 1, 2011 through June 30, 2012.  Approve an operational agreement for the Tulare County Clandestine Laboratory Enforcement Unit under the California Multi-Jurisdictional Methamphetamine Enforcement Team Program, retroactive to July 1, 2011 through June 30, 2012.  Find that the Board had authority to accept this funding and enter into the proposed agreement as of July 1, 2011, and that it was in the County's best interest to enter into the agreement on that date.  Approve the necessary budget adjustments.  (4/5ths vote required)
