4.                  Request from the County Administrative Office/General Services/Property Management to receive public comments regarding the Board's intent to consummate the purchase of property near the northwest corner of Avenue 136 and Road 232 within and adjacent to the city limits of the City of Porterville.  Approve and authorize the Chairman to execute the Notice of Exclusion and Exemption from the California Environmental Quality Act (CEQA) on the grounds that the proposed acquisition (a) is  excluded from CEQA because the acquisition does not commit the County to a definite course of action, (b) is exempt from CEQA pursuant to the general rule or common sense exemption, and (c) is exempt from CEQA because the activity, at this time, involves planning and feasibility studies.  Direct the County Administrative Officer, or designee, to file the Notice of Exclusion and Exemption with the Tulare County Clerk.  Confirm that the proposed acquisition is in conformity with the Tulare County General Plan.  Publicly consummate the purchase of real property at Avenue 136 and Road 232 within and adjacent to the city limits of the City of Porterville.  Approve the purchase of the subject property for a price of $1,729,130 and authorize the Chairman to sign the Real Estate Agreement of Purchase and Sale similar in content to attached Exhibit "B" upon submission and subject to County Counsel approval as to form.  Approve the Agricultural Lease Agreement that leases the property back to the sellers and authorize the Chairman to sign the agreement similar in content to attached Exhibit "C" upon submission and subject to County Counsel approval as to form.  Authorize the County Administrative Officer, or designee, to execute all additional documents to consummate the proposed purchase of real property.  Approve the necessary budget adjustments (4/5ths vote required).  Direct the Auditor to draw a warrant in favor of Chicago Title Company in the amount of $1,729,130 including closing costs upon request made by the County Administrative Officer, or designee.  Declare that the County has site assurance pursuant to AB900.

5.                  PUBLIC HEARING:      Request from Resource Management Agency to approve the sewer and water user fee adjustments for specified County Service Area Zones of Benefit (El Rancho, Delft Colony, Tonyville, Tooleville, Traver, Yettem, and Wells Tract sewer systems and Wells Tract water distribution system), effective August 1, 2012.

Agricultural Commissioner/Sealer

6.                  Approve the waiver of the requirements for written competitive bids and authorize the Purchasing Agent to purchase pre-mixed vertebrate pest control bait directly from the Kings County Agricultural Commissioner for resale to the citizens of Tulare County.

7.                  Approve a Capital Asset purchase for twelve replacement vehicles in the amount of $207,230.  Approve the necessary budget adjustment.  (4/5ths vote required).

Auditor-Controller/Registrar of Voters/Treasurer-Tax Collector

8.                  Approve the candidate statement regulations and printing fees for the November 6, 2012 General Election.  Require each candidate filing a statement to pay the estimated cost in advance.  The estimated cost will be adjusted to actual upon completion of the Election.  Candidates will be refunded or billed for the difference.  Limit each candidate's statement to no more than 200 words for County offices and 250 words for State offices.

9.                  Review and accept the Certified Statement of Vote as submitted by the Registrar of Voters for those offices/measures for which the Board of Supervisors is the Governing Body.

10.             Approve the Resolution authorizing the issuance of Tax and Revenue Anticipation Notes for the 2012/2013 Fiscal Year.

11.             Authorize the re-issuance of two outlawed warrants for Vanderham & Sons totaling $29,027.88.

Board of Supervisors

12.             Ratify the following Proclamations:  Honoring Bill Lewis for his dedication and service to the City of Woodlake; and Honoring Marc Sumida for earning the rank of Eagle Scout.

13.             Appoint Clint Ashcraft to the Tulare County Youth Commission, District 1 to serve at the Pleasure of the Board.

County Administrative Office

14.             Approve an agreement with the City of Exeter in the amount of $54,066 to provide full-time dispatch services retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had the authority to enter into the agreement as of July 1, 2012 and that it was in the County's best interest to enter into the agreement as of that date.

15.             Approve an agreement with the City of Farmerville in the amount of $49,470 to provide full-time dispatch services retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had the authority to enter into the agreement as of July 1, 2012 and that it was in the County's best interest to enter into the agreement as of that date.

District Attorney

16.             Approve the Personnel Resolution to add one DA Investigator (Bilingual) and one DA Investigator to the position allocation of the District Attorney's Workers Compensation Insurance Fraud Unit.

17.             Ratify and approve an agreement with the State of California, Victim Compensation and Government Claims Board for the District Attorney's Criminal Restitution Compact in the amount of $82,235 to fund a Restitution Specialist for the Victim Witness Assistance Center, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2012, and that it was in the County's best interest to enter into the agreement on that date.  Ratify the Chairman's signature on 5 copies of the agreement.  Ratify the Chairman's signature on form CCC-307 (Contractor Certification Clauses).

Health & Human Services Agency

18.             Approve a Capital Asset purchase of a Cryoablation Machine for the Visalia Health Care Center in the amount of $25,000.  Approve the necessary budget adjustments (4/5ths vote required).

19.             Approve the submission of a regional application to CalRecycle by Tulare County Health & Human Services Agency, Environmental Health Services Division on behalf of the County of Tulare and cities of Dinuba, Exeter, Farmersville, Lindsay, Porterville, Tulare, Visalia, and Woodlake for the Used Oil Payment Program (OPP) Cycle 3. Authorize the Board Chairman to execute the Application Certification.  Designate and authorize the Board Chairman as Signature Authority effective until August 15, 2014 to sign all ministerial documents necessary to secure payment under the OPP.

20.             Approve an amendment of Resolution No. 02-0530 to increase back up foster care rates from $19.40 to $40.00 a day for the care of a foster child without specified special needs and from $29.40 to $50.00 per day for the care of a foster child with special needs.

21.             Approve an amendment to Agreement No. 23165 with the State Department of Alcohol and Drug Programs to increase the agreement by $1,590,499 from $11,443,932 to $13,034,431 for combined Drug/Medi-Cal and Net Negotiated Funds to provide Substance Use Disorder services, retroactive to July 1, 2010 through June 30, 2013.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2010, and that it was in the County's best interest to enter into the amendment on that date.

22.             Approve an amendment to Agreement No. 23379 with Psynergy Programs, Inc. in an amount not to exceed $650,000 for the continued provision of specialty Medi-Cal mental health services, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2012, and that it was in the County's best interest to enter into the amendment that date.

23.             Approve an amendment to Agreement No. 24420 with Dinuba Unified School District to receive immunizations or Public Health Services from Tulare County Health & Human Services Agency, retroactive to July 1, 2012 through June 30, 2015.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2012, and that it was in the County's best interest to enter into the amendment on that date.

24.             Approve an amendment to Agreement No. 24422 with Farmersville Unified School District to receive immunizations or Public Health Services from Tulare County Health & Human Services Agency, retroactive to July 1, 2012 through June 30, 2015. Find that the Board had authority to enter into the proposed amendment as of July 1, 2012, and that it was in the County's best interest to enter into the amendment on that date.

25.             Approve an amendment to Agreement No. 24920 with Visalia Unified School District for a Clinical Training Program for students enrolled in licensed vocational nursing classes, retroactive to July 1, 2012 through June 30, 2015.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2012, and that it was in the County's best interest to enter into the amendment on that date.

26.             Approve an amendment to Agreement No. 25038 with Victor Treatment Centers, Inc. in an amount not to exceed $110,000 for the provision of Intensive Day Treatment services (Full Day) to Tulare County minors, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2012, and that it was in the best interest of the County to enter into the amendment on that date.

27.             Approve an amendment to Agreement No. 25041 with Tulare Youth Services Bureau, Inc. for the provision of mental health services to Tulare County adolescents and children, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2012, and that it was in the County's best interest to enter into the amendment on that date.

28.             Approve an amendment to Agreement No. 25063 with Psynergy Programs, Inc. in an amount not to exceed $1,050,000 for the provision of Adult Residential mental health services, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2012, and that it was in the County's best interest to enter into the amendment on that date.

29.             Approve an amendment to Agreement No. 25111 with EMQ Families First, Inc. for the provision of mental health services in an amount not to exceed $470,895, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed amendment as of July 1, 2012, and that it was in the County's best interest to enter into the amendment on that date.

30.             Approve an agreement with Dinuba Unified School District for Tulare County Health & Human Services Agency, as the Local Government Agency, to act as the claims processing agent of Medi-Cal Administrative Activities claims on behalf of their school district, retroactive to July 1, 2012 through June 30, 2015.  Find that the Board had authority to enter into proposed agreement as of July 1, 2012, and that it was in the County's best interest to enter into the agreement on that date.

31.             Approve an agreement with Exeter Elementary School for Tulare County Health & Human Services Agency, as the Local Government Agency, to act as the claims processing agent for Medi-Cal Administrative Activities claims on behalf of their school district, retroactive to July 1, 2012 through June 30, 2015.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2012, and that it was in the County's best interest to enter into the agreement on that date.

32.             Approve an agreement with Exeter Union High School for Tulare County Health & Human Services Agency, as the Local Government Agency, to act as the claims processing agent of Medi-Cal Administrative Activities claims on behalf of their school district, retroactive to July 1, 2012 through June 30, 2015.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2012, and that it was in the County's best interest to enter into the agreement on that date.

33.             Approve the renewal agreement with the State Water Resources Control Board for funding in the amount of $155,176 for the Local Oversight Program (LOP) that provides for local oversight of the investigation and remediation of leaking underground storage tanks in Tulare County, retroactive from July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed agreement on July 1, 2012, and that it was in the County's best interest to enter into the agreement on that date.

34.             Approve the Clinical Internship Agreement between College of the Sequoias and Tulare County Health & Human Services Agency, Public Health Division, to provide supervised educational clinical experience for students enrolled in the College of the Sequoias Nursing Program, retroactive to March 1, 2012 through June 30, 2016.  Find that the Board had authority to enter into the proposed Clinical Internship Agreement as of March 1, 2012, and that it was in the best interest of the County to enter into the Memorandum of Understanding on that date.

35.             Approve an agreement with the California Ventura Automated Collection System Association in an amount not to exceed $11,497 for Tulare County's participation in the joint enhancement committee regarding Ventura Automated Collection System, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2012, and that it was in the County's best interest to enter into the agreement on that date.  Authorize the Director of the Tulare County Health & Human Services Agency to sign Attachment E, Assurance of Compliance with the California Department of Social Services Nondiscrimination in State and Federally Assisted Programs.

36.             Approve an agreement with Allied Barton Security Service LP in an amount not to exceed $2,413,892 to provide security guard services from August 1, 2012 through June 30, 2014 for Tulare County Health & Human Services Agency, the Tulare County Library, and the Tulare County Department of Child Support Services.

37.             Approve an agreement with Visualutions, Inc. in an amount not to exceed $325,000 to provide software maintenance and support for the County Health Operations, retroactive to March 1, 2012 through June 30, 2014.  Find that the Board had authority to enter into the proposed agreement as of March 1, 2012, and that it was in the County's best interest to enter into the agreement on that date.

38.             Approve a Memorandum of Understanding with Alta Vista School to place a book machine on the school grounds.

Probation

39.             Approve an amendment to Agreement No. 21655 with Porterville Unified School District to extend the term of the agreement for the services of two Probation Officers for the continued Campus Probation Officer Program, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2012, and that it was in the County's best interest to enter into the agreement as of that date.

40.             Approve an amendment to Agreement No. 21656 with the City of Dinuba to extend the term of the agreement for the services of one Probation Officer for the Non-Custody Intake Program, retroactive to July 1, 2012 through June 30, 2013.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2012, and that it was in the County's best interest to enter into the agreement as of that date.

47.             Approve an amendment to Agreement No. 25307 with the United States Forest Service to increase the funding amount by $100,000 for operations to suppress manufacturing and trafficking of controlled substances on or affecting National Forest Service land, retroactive to October 1, 2011, through September 30, 2012.  Find that the Board had authority to enter into the agreement as of October 1, 2011, and that it was in the County's best interest to enter into the Agreement on that date.

49.             Request from the County Administrative Office/Property Management to instruct Property Management Staff on the Visalia Courthouse Food Service Concession Alternatives.  The Alternatives are as follows:  1.  Continue on a month-to-month tenancy should Mr. Medina agree.  2.  Offer Mr. Medina a six (6) month term to remain if he agrees and release a Request for Proposals for a new food service vendor.  3.  Offer Mr. Medina a longer term to continue his business with the same terms and conditions or with modified terms and conditions.  4.  Allow the license to expire and seek other county use of the space.  5.  Any other options the Board considers approriate.

 

50.             Request from Workforce Investment Board to approve the Personnel Resolution deleting one (1) Workforce Development Deputy Director, one (1) Workforce Development Program Coordinator, three (3) Business Resource Specialist, one (1) Workforce Development Analyst, and adding one (1) Workforce Services Program Manager, one (1) Business Services Program Manager in an effort to improve organizational structure and operational efficiency.  Adopt two (2) new classifications for Workforce Services Program Manager and Business Services Program Manager, Salary Grade 119.

51.             Request from Resource Management Agency to approve and award the contract to the lowest responsive and responsible bidder for construction of Avenue 416 Replacement Bridge over the Kings River.  Authorize the Chairman to sign the contract after review and approval as to form by County Counsel and upon receipt of certificates of insurance, bonds and evidence that the contractor possesses a valid State Contractor's license.  Allow funds for contingencies in the amount of ten percent (10%) of the contract amount to cover unexpected construction conditions.

52.             Request from Resource Management Agency to approve the reclassification of two Planner III positions to Planner IV positions in the Resource Management Agency (RMA) Countywide Planning Division, per the Personnel Resolution.

53.             Request from Resource Management Agency to approve the move of two positions from the RMA Solid Waste Division to the RMA Roads Division.  Approve the addition of one Deputy Assistant RMA Director - Public Works Branch (At-Will) in the RMA Roads Division, effective July 10, 2012, and approve the class specification and title for this position with salary band set at B03, per the Personnel Resolution.
