4.                  Approve an Agreement with the California Department of Food and Agriculture for providing State subvention in the amount of $21,541.38 to offset costs of providing Sudden Oak Death inspection services, retroactive to July 1, 2013 through June 30, 2014.  This Agreement is retroactive because the document was not received from the State until October 15, 2013. Find that the Board had authority to enter into the proposed Agreement as of July 1, 2013, and that it was in the County's best interest to enter into the Agreement on that date.

Capital Projects and Facilities

8.                  Accept the Visalia Health Care Center Roofing Project at 2611 N Dinuba Blvd., Visalia, as a completed project.  Authorize the Chairman of the Board of Supervisors to sign the Notice of Completion for the subject project. Direct the Clerk of the Board of Supervisors to record the Notice of Completion for the subject project with the office of the Tulare County Recorder.

County Administrative Office

9.                  Approve proclaiming "Court Adoption and Permanency Month" this year from November 1 through November 30, 2013 in Tulare County.

District Attorney

10.             Ratify and approve the Grant Award Agreement for acceptance of grant funding from the Insurance Commissioner of the State of California for the Automobile Insurance Fraud Prosecution Program in the amount of $218,462, retroactive to July 1, 2013 through June 30, 2014 .  Recognize an additional $11,168 in carry over funds from Fiscal Year 2012/2013 for a total of $229,630. Ratify and approve the District Attorney's signature on the Agreement. Find that the Board had authority to enter into the proposed agreement as of July 1, 2013 and that it was in the County's best interest to enter into the agreement on that date. Direct the Board Clerk to prepare a certified copy of the resolution for the District Attorney's Office. Approve the necessary budget adjustments (4/5ths vote required).

11.             Ratify and approve the Grant Award Agreement for acceptance of grant funding from the Insurance Commissioner of the State of California for the Workers' Compensation Insurance Fraud Prosecution Program in the amount of $504,211, retroactive to July 1, 2013 through June 30, 2014, and recognize an additional $31,475 in carry over funds from Fiscal Year 2012/2013, for a total of $535,686.  Ratify and approve the District Attorney's signature on the Agreement.  Find that the Board had authority to enter into the proposed agreement as of July 1, 2013, and that it was in the County's best interest to enter into the agreement on that date.  Direct the Board Clerk to prepare a certified copy of the Resolution for the District Attorney's Office.  Approve the necessary budget adjustments (4/5ths vote required).

Fire Department

12.             Approve an agreement with the California Department of Forestry and Fire Protection's Volunteer Fire Assistance (VFA) Grant to accept grant funding in the amount of $20,000, commencing on the last signatory date of the agreement and continuing through June 30, 2014.

Health & Human Services Agency

13.             Approve an agreement with Community Services and Employment Training, Inc. (CSET) for the Youth Transition Program in the amount not to exceed $605,946, retroactive from October 1, 2013 through September 30, 2014. Find that the Board had authority to enter into the proposed agreement as of October 1, 2013, and that it was in the County's best interest to enter into the agreement on that date.

14.             Approve an agreement with Psynergy Programs, Inc. in an amount not to exceed $1,700,000 for the provision of residential and Medi-Cal specialty mental health services, retroactive to July 1, 2013 through June 30, 2014. Find that the Board had authority to enter into the proposed agreement as of July 1, 2013 and that it was in the County's best interest to enter into the agreement on that date.

15.             Approve an agreement with Aurora Vista Del Mar Hospital in an amount not to exceed $1,500,000 to provide short term, acute inpatient psychiatric services retroactive to July 1, 2013 through June 30, 2014. Find that the Board had authority to enter into the proposed agreement as of July 1, 2013 and that it was in the County's best interest to enter into the agreement on that date.

16.             Approve an agreement with Community Services and Employment Training, Inc., in an amount not to exceed $309,544 ($103,181 per year) for the provision of increased youth knowledge and awareness regarding the consequences of underage drinking, retroactive to October 1, 2013 through June 30, 2016. Find that the Board had authority to enter into the proposed agreement as of October 1, 2013, and that it was in the County's best interest to enter into the agreement on that date.

17.             Approve an agreement with Tulare County Superintendent of Schools in an amount not to exceed $171,015 ($51,005 for Fiscal Year 2013/2014 and $60,005 per year for Fiscal Years 2014/2015 and 2015/2016) for the provision of increased youth knowledge and awareness regarding the consequences of underage drinking, retroactive to October 1, 2013 through June 30, 2016. Find that the Board had authority to enter into the proposed agreement as of October 1, 2013, and that it was in the County's best interest to enter into the agreement on that date.

18.             Approve an agreement with the National Council on Alcoholism and Drug Dependence for the provision of alcohol and drug prevention services in an amount not to exceed $510,048 ($170,016 per year), retroactive to October 1, 2013 through June 30, 2016. Find that the Board had authority to enter into the proposed agreement as of October 1, 2013, and that it was in the County's best interest to enter into the agreement on that date.

19.             Approve an agreement with Family Services of Tulare County in an amount not to exceed $138,996 ($40,332 for Fiscal Year 2013/2014 and $49,332 per year for Fiscal Years 2014/2015 and 2015/2016) for the provision of alcohol and drug prevention services, retroactive to October 1, 2013 through June 30, 2016. Find that the Board had authority to enter into the proposed agreement as of October 1, 2013, and that it was in the County's best interest to enter into the agreement on that date.

Probation

20.             Approve an amendment to Agreement No. 25592 with Turning Point of Central CA to amend the effective date to July 1, 2012 and to increase the maximum amount  for payment for services to $350,000. Find that the Board had authority to enter into the proposed agreement as of July 1, 2012, and that it was in the County's best interest to enter into the agreement on that date.

21.             Approve an amendment to Agreement No. 25986 with The PAAR Center to amend the effective date to January 1, 2013 and to increase the maximum amount for payment for services to $350,000.  Find that the Board had authority to enter into the proposed agreement as of January 1, 2013, and that it was in the County's best interest to enter into the agreement on that date.

Resource Management Agency

22.             Introduce and waive the first reading of an amendment to Ordinance No. 352, the Tulare County Zoning Ordinance, for Change of Zone No. PZ 11-001 to change the zoning designation on a 20-acre parcel from MR-217 (Mountain Residential-217,000 sq. ft. minimum) to CO (Commercial Recreation) on property located on the north side of Goman Road, approximately 400 feet west of Kennedy Meadows Road, in Kennedy Meadows.  Set the Public Hearing for December 3, 2013, at 9:30 a.m. or shortly thereafter as the matter may be heard.

Solid Waste

23.             Approve an amendment to Agreement No. 24503, extending the term by 6 months to May 31, 2013, for construction and demolition recycling services at County landfills, subject to review and approval by County Counsel.

Authorize the Chairman of the Board of Supervisors to execute the Real Estate Donation Transfer Agreement and the Grant Deed describing the property to the Boys and Girls Club of Tulare County dba: Boys and Girls Club of the Sequoias. Direct the Clerk of the Board to return the executed Grant Deed to Property Management for transmittal to escrow. Approve the Exhibit B categorical exemption pursuant to the California Environmental Quality Act (CEQA) Guidelines (General Rule Exemption per Section 15312) for the transfer of this surplus property. Authorize the Chairman of the Board to sign a United States Department of Agriculture Rural Housing Services Community Facilities Grant Agreement Addendum, subject to approval as to form by County Counsel, in a format similar to Exhibit C. Direct the Environmental Assessment Officer, or designee, of the Tulare Resource Management Agency to file the appropriate exemption with the Tulare County Clerk.  Authorize the County Administrative Officer, or his designee, to approve and execute all additional documents to consummate this donation transfer of property.

25.             Request from Health and Human Services Agency to approve the Tulare County Mental Health Services Act, Capital Facilities Project Proposal in the estimated amount of $2,336,000. Authorize the Tulare County Director of Mental Health to sign the face sheet exhibits and submit the Mental Health Services Act, Capital Facilities Project Proposal to the State Department of Health Care Services.

26.             Request from Resource Management Agency to approve the Resource Management Agency Fiscal Year 13/14 through Fiscal Year 17/18 Five-Year Capital Improvement Plan.

27.             Presentation given by the County Administrative Office regarding an update on the Tulare Lake Basin Disadvantaged Community Water Study.  Approve an amendment to Agreement No. 24992 with Provost and Pritchard to increase the amount from $1,600,000 to $1,835,000.
